Welcome to Eudaimonia (the "Service"). These Terms of Use ("Terms") govern your access to and use of our web application and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Age Verification
You must be at least 18 years old (If the age of majority in your jurisdiction is higher, you must meet that requirement) to access or use the Services. By accessing this Service, you affirm that you are of legal age to view adult content in your jurisdiction. We reserve the right to request proof of age and to deny access to any user who cannot provide satisfactory verification.

2. Acceptance of Terms
By accessing and using the Services, you warrant that you are legally able to enter into these Terms and that your use of the Services does not violate any law or regulation applicable to you.

3. Changes to Terms
We may modify these Terms from time to time. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.

4. User Accounts
To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate access in case of misuse or violation of these terms.

5. Use of the Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You are prohibited from using the Services:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- To transmit, or procure the sending of, any advertising or promotional material.
- To impersonate or attempt to impersonate Eudaimonia, an Eudaimonia employee, another user, or any other person or entity.

6. AI-Generated Content and User Responsibility
The Service allows users to interact with artificial intelligence systems that may generate text, dialogue, instructions, suggestions, or other content as part of fictional role-playing experiences. You acknowledge and agree that all content generated by the AI is provided for entertainment and fictional purposes only.

You understand that the AI may generate content that is inaccurate, inappropriate, misleading, or potentially harmful. Eudaimonia does not control, endorse, or guarantee the accuracy, legality, safety, or suitability of any AI-generated content.

You are solely responsible for your interactions with the AI and for any actions you choose to take based on AI-generated content. You agree that you will not follow or rely on any AI-generated instructions or suggestions that are illegal, unsafe, dangerous, harmful, or detrimental to your physical or mental health, or that violate these Terms or applicable laws and regulations.
This includes, but is not limited to, content related to violence, self-harm, criminal or illegal activities, substance use, medical or health-related procedures, or any other high-risk or potentially harmful behaviors.

Eudaimonia shall not be held liable for any damage, injury, loss, or harm arising from or related to your use of, reliance on, or interpretation of AI-generated content. Use of the Service is at your own risk.

6.1. No Reliance on AI Instructions
You expressly acknowledge that the AI is not a human, professional, or authority, and its outputs do not constitute advice, instructions, or recommendations of any kind. Under no circumstances should AI-generated content be treated as professional, medical, legal, or safety guidance.

Eudaimonia expressly disclaims any responsibility for actions taken by users in response to AI-generated content. Any decision to act upon such content is made independently and entirely at the user’s own discretion and risk.

7. Electrical Stimulation (E-Stim) Activities
The Service may generate audio signals intended for use with electrical stimulation (e-stim) devices. By using any e-stim related features of the Service, you acknowledge and agree to the following:

7.1. Assumption of Risk
Electrical stimulation involves inherent risks, including but not limited to skin irritation, burns, muscle injury, nerve damage, cardiac arrhythmia, and in extreme cases, death. You acknowledge that you engage in e-stim activities entirely at your own risk and of your own free will. Eudaimonia does not manufacture, sell, or control any physical e-stim hardware, electrodes, or accessories, and assumes no responsibility for the equipment you use in conjunction with the Service.

7.2. Medical Contraindications
You must NOT use the e-stim features of the Service if any of the following apply to you:
- You have a pacemaker, implanted defibrillator, or any other implanted electronic medical device.
- You have a heart condition, cardiac arrhythmia, or history of cardiac events.
- You have epilepsy or a seizure disorder.
- You are pregnant.
- You have impaired sensation or skin conditions in the area of electrode placement.
- You have any medical condition that may be adversely affected by electrical stimulation.
If you are uncertain whether e-stim is safe for you, you must consult a qualified medical professional before using these features. Eudaimonia does not provide medical advice, and no content or signal generated by the Service constitutes medical guidance.

7.3. Safe Use Requirements
You agree that you will:
- Never place electrodes across the chest, over the heart, on the head, on the throat or neck, or over broken or irritated skin.
- Never use e-stim near water or in wet conditions.
- Never use e-stim while operating a vehicle or heavy machinery.
- Never use e-stim while sleeping or under the influence of alcohol, drugs, or medication that impairs judgment or sensation.
- Always start at the lowest intensity setting and increase gradually.
- Always ensure you are able to immediately disconnect or power off your e-stim device at any time.
- Only use equipment that is designed and rated for use on the human body.

7.4. No Warranty of Signal Safety
Audio signals generated by the Service are provided on an "as is" basis. While Eudaimonia endeavors to implement reasonable safeguards in its signal generation, Eudaimonia does not warrant or guarantee that any audio signal produced by the Service is safe for use with any particular e-stim device, electrode configuration, or individual user. Variations in hardware, audio output devices, impedance, electrode placement, and individual physiology may produce unpredictable results. You are solely responsible for verifying that any signal is safe before applying it to your body.

7.5. Release and Waiver of Liability
To the fullest extent permitted by applicable law, you hereby release, waive, and forever discharge Eudaimonia, its officers, directors, employees, agents, affiliates, and licensors from any and all claims, demands, damages, losses, costs, expenses, or liability of any kind arising out of or relating to your use of e-stim features of the Service, including but not limited to personal injury, property damage, or death, whether caused by negligence, equipment malfunction, signal characteristics, or otherwise.

You expressly agree that this release and waiver is intended to be as broad and inclusive as permitted by the laws of France, and that if any portion is held invalid, the remainder shall continue in full force and effect.

8. User Content
You are solely responsible for any content you post, upload, or otherwise submit to the Service ("User Content"). You grant Eudaimonia a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute any User Content you provide through the Service.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Eudaimonia and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

10. Disclaimers
The Services are provided on an "as is" and "as available" basis. Eudaimonia does not warrant that the Services will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, Eudaimonia disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of Liability
In no event shall Eudaimonia, its affiliates, or their licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Services; (ii) any conduct or content of any third party on the Services; (iii) any personal injury, bodily harm, or property damage resulting from your use of electrical stimulation features, audio signals generated by the Service, or any equipment used in conjunction with the Service, regardless of whether such damages were foreseeable or whether Eudaimonia was advised of the possibility of such damages.

12. Changes to the Service
We reserve the right to modify or discontinue the Service (or any part thereof) with or without notice to you. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

2. Definitions
"Subscription" refers to a recurring monthly plan (Tier 1, 2, or 3) granting access to the Services and a monthly credit allowance.
"Extra Credit Pack" refers to a one-time purchase of additional credits (text generation or image generation) that supplements the Subscription allowance.
"Credits" refers to the unit of consumption used to access text generation, image generation, speech recognition, and text-to-speech features.
"Services" refers to all features and tools made available through the Eudaimonia platform.

3. Service Description
3.1 Subscriptions
We offer digital services through a monthly subscription model. Users can choose between three service tiers, each providing a fixed monthly credit allowance and access to platform features. Details and pricing are available here.

3.2 Extra Credit Packs
In addition to subscriptions, users may purchase Extra Credit Packs as one-time top-ups. Key terms:

  • An active subscription is required to purchase and use Extra Credit Packs.
  • Two types of packs are available: Text Generation credits and Image Generation credits. Credits from one type cannot be converted to another.
  • Credits are added instantly upon successful payment and are usable immediately.
  • Extra credits expire 6 months after the date of purchase, regardless of whether they have been used. Unused credits are permanently lost upon expiration.
  • If your subscription expires or is cancelled, remaining extra credits are frozen until you resubscribe. Their expiration date is not extended.
  • There is no limit on the number of packs you may purchase simultaneously.
3.3 Credit Consumption Order
Credits are consumed in the following order:
  1. Subscription credits are always used first.
  2. Once the monthly allowance is depleted, extra credits from the pack closest to its expiration date are consumed next (first-to-expire, first-out).

4. Pricing and Payment
Subscriptions are billed monthly. Extra Credit Packs are billed as one-time payments at the time of purchase.

All payments are processed securely via Stripe. Eudaimonia does not store your payment information.

Prices are listed in euros (EUR). VAT is not applicable under Article 293 B of the French General Tax Code (Code Général des Impôts).

Eudaimonia reserves the right to modify pricing at any time. Price changes will only apply to future purchases and upcoming billing cycles, not to active subscriptions or previously purchased packs.

5. Cancellation and Refunds
5.1 Subscriptions
You may cancel your subscription at any time via your account dashboard. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months or unused subscription credits.

5.2 Extra Credit Packs
All Extra Credit Pack purchases are final. Packs cannot be refunded, transferred, or exchanged once purchased.

6. Right of Withdrawal
In accordance with Articles L221-18 and L221-28 of the French Consumer Code (Code de la consommation):

6.1 Subscriptions
By subscribing, you expressly request immediate access to the Services and acknowledge that this constitutes the beginning of performance. You therefore waive your 14-day right of withdrawal once the Services have been made available to you.

6.2 Extra Credit Packs
By purchasing an Extra Credit Pack, you expressly consent to the immediate delivery of the digital content and acknowledge that you waive your 14-day right of withdrawal once the credits have been added to your account.

7. Service Availability
We strive to maintain service availability at all times, but interruptions may occur due to maintenance, updates, third-party API outages, or circumstances beyond our control.

Eudaimonia shall not be held liable for any damages resulting from service downtime, degraded performance, or third-party service failures.

Failed generations that do not return a result will not be charged against your credit balance.

8. Limitation of Liability
The Services are provided "as is" with no guarantees regarding output quality, accuracy, or fitness for a particular purpose.

Eudaimonia's total liability, to the extent permitted by law, shall not exceed the amount paid by the user during the 3 months preceding the event giving rise to the claim.

9. Modifications to These Terms
Eudaimonia reserves the right to update these Conditions of Sale at any time. Users will be notified of material changes via email or an in-app notice. Continued use of the Services after notification constitutes acceptance of the updated terms.

10. Governing Law and Disputes
These Conditions of Sale are governed by French law.

In the event of a dispute, you may contact us at contact@daimonia.app to seek an amicable resolution. If no agreement is reached, you may refer the matter to a certified consumer mediator in accordance with Articles L611-1 et seq. of the French Consumer Code, or to the European Commission's Online Dispute Resolution platform.

By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Conditions of Sale.
